Slander cases are fairly straightforward to prove and involve “the speaking of base or defamatory words tending to prejudice another in his reputation, office, trade, business or means of livelihood.” Basically, if someone says something about you to another person or people that harms your reputation or business, you may have a case against them for slander.
Another form of slander is “oral defamation” or the speaking of false, malicious or defamatory words concerning another whereby injury results to his reputation. “Libel” is closely related to slander, but involves written defamatory expressions, such as newspaper articles or stories in popular tabloid magazines.
The essential elements of libel-slander are:
- False statement.
- Unprivileged communication.
- Fault amounting at least to negligence on the part of the publisher.
- The statement caused some sort of harm to your reputation, office, business, or livelihood or had the ability to cause that sort of harm.
